1. Services & Booking

Costa Maya Riders ("we", "us", "our") provides ATV tours, golf cart rentals, and guided excursions in Mahahual, Quintana Roo, Mexico. By completing a booking through our website (costamayariders.com) or any other channel, you ("the client") agree to these Terms and Conditions in full.

Booking Confirmation

A booking is confirmed only upon receipt of the required deposit and issuance of a confirmation email containing your unique booking reference code and QR code.

Check-In Requirements Upon Arrival

Every client must present the following documents at the meeting point before the tour or rental begins:

Costa Maya Riders reserves the right to deny service to any person who cannot verify their identity or present the corresponding booking code. No refund will be issued in such cases.

Availability

All tours and rentals are subject to availability. We reserve the right to reschedule or cancel any tour due to adverse weather, insufficient participants, mechanical issues, or circumstances beyond our control. In such cases, clients will be offered a full refund or an alternative date.

Cruise Ship Guests

It is the client's sole and exclusive responsibility to know their ship's exact sailing time, manage their own schedule, and return to the Costa Maya port well in advance of departure. Costa Maya Riders makes every reasonable effort to assist guests with timing; however, we do not guarantee any specific return time, as departure times are always subject to road conditions, weather, group pace, and other variables beyond our control.

⚠️ Missed Ship β€” No Liability: Costa Maya Riders is NOT responsible and will NOT cover, reimburse, or compensate for any costs or damages related to a missed cruise ship departure under any circumstances β€” including flight rebooking, hotel stays, meals, alternative transportation, port fees, or any other expense. By booking with us, the client expressly accepts full responsibility for returning to their ship on time.

2. Payments & Deposits

To secure your reservation, a deposit of 20% of the total tour price is required at time of booking. The remaining balance is due in cash (USD) upon arrival at the meeting point.

Payment Processing

Online payments are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. Costa Maya Riders does not store your card details on our servers. By proceeding with payment, you also agree to Stripe's Terms of Service.

Pricing

All prices are displayed in US Dollars (USD) and are per person unless otherwise stated. Prices are subject to change without notice; however, the price confirmed at booking will be honored.

3. Cancellations

Client Cancellations β€” No Refund Policy

⚠️ All deposits and payments are strictly non-refundable. By completing a booking and making a payment, the client expressly accepts that no refund will be issued under any circumstances attributable to the client, including but not limited to: cancellation, change of plans, no-show, late arrival, incorrect date, or any other client-side reason.

Cancellation by Costa Maya Riders β€” Force Majeure

Only in the event that Costa Maya Riders cancels the service due to force majeure or fortuitous events (extreme weather, natural disasters, health emergencies, governmental prohibition, or other causes beyond our control) will the deposit or payment be refunded to the client.

To process such a refund, the client must contact us at bookings@costamayariders.com with their booking reference code. Refunds will be processed within 5–10 business days.

4. Safety, Vehicle Use & Liability

By booking, renting, driving, riding, or participating in any activity provided by Costa Maya Riders, the client expressly acknowledges and accepts that the use of ATVs, motorcycles, golf carts, and any other rented vehicle involves inherent risks, including but not limited to personal injury, collision, property damage, mechanical damage, loss, theft, and accidents caused by terrain, road conditions, weather, third parties, or improper use of the vehicle.

Participation Requirements

Mandatory Safety Equipment

All drivers and passengers must wear the safety equipment provided by Costa Maya Riders at all times during the activity or rental period. This includes, when applicable:

Refusal to wear the required safety equipment will result in denial of service or immediate cancellation of the activity without refund. If the client removes, refuses, misuses, or damages the required safety equipment, Costa Maya Riders shall not be responsible for any injury, accident, or damage resulting from such conduct.

Driver Responsibility

The driver and/or renter is fully responsible for the safe, careful, and lawful operation of the vehicle during the entire rental or activity period. The client agrees to:

Costa Maya Riders reserves the right to cancel or terminate the activity immediately, without refund, if the client behaves recklessly, ignores staff instructions, endangers others, or operates the vehicle in an unsafe manner.

Accidents, Damages & Financial Responsibility

The client accepts full responsibility for any accident, damage, loss, theft, fine, injury, or third-party claim caused directly or indirectly by the client's use, misuse, negligence, or failure to follow Costa Maya Riders' rules.

Any damage to vehicles, equipment, helmets, safety gear, or third-party property during the rental or activity will be charged to the client.

In the event of an accident, collision, rollover, misuse, mechanical damage, loss, theft, or material damage to the vehicle or equipment, Costa Maya Riders may charge the client a damage penalty of up to USD $2,000.00, in addition to any repair, replacement, towing, recovery, legal, medical, or third-party costs that may apply. If the total damage exceeds USD $2,000.00, the client remains responsible for the full amount.

Vehicle Inspection Before and After Use

Before receiving the vehicle, the client must inspect it together with Costa Maya Riders staff. Any pre-existing damage must be reported before the activity begins. Upon return, Costa Maya Riders may inspect the vehicle. If new damage is found, the client may be charged accordingly. Failure to report an incident immediately may result in additional charges.

Personal Belongings

Costa Maya Riders is not responsible for loss, theft, or damage to personal belongings β€” including phones, cameras, wallets, sunglasses, jewelry, clothing, documents, or any other personal item. Clients are responsible for securing their own belongings during the tour or rental period.

Assumption of Risk & Release of Liability

By completing a booking or participating in any activity, the client confirms that they understand the risks involved and voluntarily assume full responsibility for their participation and vehicle use. The client releases Costa Maya Riders, its owners, partners, employees, guides, operators, affiliates, and representatives from liability for accidents, injuries, losses, or claims resulting from the client's negligence, failure to follow instructions, or violation of these Terms and Conditions.

Behavior Policy

Participants under the influence of alcohol or drugs will not be permitted to join any tour. We reserve the right to remove any participant whose behavior endangers themselves or others, without refund.

5. Photos & Media

Our guides may take photos or videos during the tour for promotional use on our website and social media (Instagram, Facebook, etc.). By participating in a tour, you grant Costa Maya Riders a non-exclusive, royalty-free license to use images in which you appear for marketing purposes. If you do not wish to appear in promotional materials, please notify your guide before the tour begins.

6. Privacy Policy & Data Use

Costa Maya Riders is committed to protecting your personal data. This policy explains what information we collect, how we use it, and your rights under the Mexican Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP).

Your Authorization

By completing a booking, you expressly authorize Costa Maya Riders to collect, store, and use the personal data you provide for the purposes described above, in accordance with the LFPDPPP. You may withdraw this authorization at any time by contacting us at bookings@costamayariders.com.

Data Sharing

We do not sell or rent your personal data. We may share limited data with the following trusted service providers solely to operate our business:

Data Retention

We retain your personal data for a maximum of 3 years after your last interaction with us, after which it is securely deleted, unless retention is required by Mexican law.

Our website uses essential cookies only β€” no tracking or advertising cookies. Session cookies are required for the booking form to function and are deleted when you close your browser. 8. Contact & Governing Law

Governing Law

These Terms and Conditions are governed by the laws of the United Mexican States, specifically the state of Quintana Roo. Any disputes shall be submitted to the courts of Chetumal, Quintana Roo, Mexico.

Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of the revised terms.
